DEEP THIRD

Privacy policy

Deep Third Labs LLC · Version 2.3 · Effective 22 October 2026

This policy explains what personal information Deep Third collects, why, who handles it, how long we keep it, and the choices you have. Sections 1 to 11 cover this website and its waitlist. Section 12 covers the Deep Third app, which is for people in the United States; the terms of use say what you agree to when you use it.

In short

  • If you join the waitlist, we keep your email address and anything else you choose to add: your name, your role, and your club, school or academy.
  • We use these details only to contact you about access to Deep Third.
  • We do not sell them, use them for advertising, or give them to anyone for their own marketing.
  • This website sets no cookies and runs no analytics or advertising tools.
  • If you use the Deep Third app, it also keeps your Google name and email address and the recordings you upload, which show you and other people. We use those recordings to analyse your sessions and to train our models, under the perpetual and irrevocable licence in the terms of use (section 12).
  • We do not use facial recognition. Nothing in Deep Third finds, measures or recognises faces, and nothing identifies who a person is (section 12.6).
  • Email admin@deepthird.com to see, correct or delete your details, or to stop hearing from us.

1. Who we are

Deep Third Labs LLC, a California limited liability company, runs deepthird.com and is responsible for your personal information. Contact: admin@deepthird.com.

2. What we collect

When you join the waitlist, we store:

  • your email address (required);
  • your name, if you give it;
  • your role (player, coach, parent, club or league official, school or academy, or other), if you choose one;
  • your club, school or academy, if you give it;
  • the tag of the link that brought you to the page, if the address you followed had one (for example ?ref=instagram); and
  • when you joined, and when you last signed up with the same address.

If you sign up again with the same address, we keep one entry and update it with what you give.

When you visit the site, the company that hosts it processes your IP address and the technical details your browser sends, to deliver the pages and to protect the site from attacks. We do not store your IP address with your sign-up, and we do not use these details to work out who you are.

We do not use cookies or similar technology on this site, and we run no analytics or advertising tools. No other company collects information about your browsing on this site.

3. How we use it

  • To email you about access to Deep Third: when a place opens, and how to start.
  • To decide whom to invite first, using your role and organisation.
  • To see which links bring people to the page.
  • To keep the site running and secure.

We do not use your details for advertising, and we make no automated decisions about you.

4. Who we share it with

We do not sell or share your personal information, and we do not give it to anyone for their own marketing. We disclose it only to:

  • Service providers that handle it for us under contract: the company that hosts this site and stores the waitlist and, once we start sending email, an email delivery service.
  • Authorities, when the law requires it, for example under a court order.
  • A buyer of our business, if Deep Third is sold or merged. The buyer must keep to this policy for the information we hold.

5. Where it is kept

Our hosting provider stores the waitlist and may process it in the United States and in other countries where it runs servers. It handles personal information for us under a data processing agreement.

6. How long we keep it

We keep your sign-up until you ask us to delete it, or until we close the waitlist and no longer need it to contact you about access to Deep Third. If you ask us to delete it, we do so within 30 days.

7. How we protect it

The site is served over an encrypted connection (HTTPS). Only Deep Third can read the waitlist, and reading it needs a secret key. No way of storing or sending information is completely secure, but we limit who can reach it.

8. Your choices and rights

Wherever you live, you can email admin@deepthird.com to:

  • get a copy of the details we hold about you;
  • correct them;
  • delete them; or
  • stop hearing from us. Every email we send will also include a way to stop further emails.

We answer within 30 days. We may ask you to confirm the request from the address on the list, so that no one else can change or delete your details. We will not treat you differently for using these rights. If you are in the European Economic Area, the United Kingdom or Switzerland, you can also complain to your data protection authority.

9. Children

Deep Third is for people aged 18 or over. Do not join the waitlist if you are under 18; a parent or coach can join with their own details. We do not knowingly collect personal information from children under 13, and if we learn that we have, we delete it.

10. Do Not Track and Global Privacy Control

We do not track you across other websites and we do not sell or share personal information, so browser Do Not Track and Global Privacy Control signals do not change how this site works.

11. California

This policy is our notice under the California Online Privacy Protection Act. We do not disclose personal information to third parties for their direct marketing (California Civil Code section 1798.83).

12. The Deep Third app

This section applies when you use the Deep Third app. The terms of use say what you agree to; this section says what personal information the app handles.

12.1 What the app collects

  • From Google, when you sign in: your name, your email address and your Google account ID. We never receive your Google password.
  • The recordings you upload. They show you and other people: players, umpires and anyone else in view.
  • What we derive from them: clips, ball and bat tracks, event times, estimates of speed, length and line, the groups of players in each session, a head-and-shoulders picture of each player taken from the recording and, for Player Spotlight, a highlight reel of your own play.
  • Names you type for the player groups in the app, if you choose to.
  • What you give us when you upload: the file name and, when the page asks, a title and the pitch length; whether anyone under 18 appears in it and your confirmation that a parent or guardian agreed; a scorecard link and your name as it appears on that scorecard; your answers to the other questions on the upload page; and, if you give it, your Instagram handle.
  • The scorecard at your link. We read the session's scorecard, which lists the players and their scores, to find your part in the recording.
  • The approximate region of each upload: the US state, or the country, that the connection of each upload comes from, kept with the recording. We do not keep the IP address with it.
  • Your feedback and problem reports, with the page of the app you were on.
  • A record of what you agreed to: which document (the terms of use or this policy) and which version, the words shown beside each tick and your answer, when, the approximate region of your connection, and the description your browser gives of itself.
  • Technical data: our hosting provider keeps a log of the requests your browser makes to the app, with your IP address and browser details, for up to 7 days.

12.2 How we use it

  • To analyse your recordings and show you the results, or make your highlight reel and email you a link to it.
  • To line up the scorecard with the recording and find your part in it, using your name on the scorecard.
  • To train, test and improve our cricket analysis models, as the terms of use allow. We never train anything to recognise who a person is.
  • To post clips that feature you, including your Player Spotlight reel, on our social media, only if you ticked that box.
  • To email you about your account and your analysis, for example when results are ready, and about Deep Third.
  • To decide, from the approximate region of an upload, whether the app groups the players in that recording (section 12.6).
  • To keep the app running and secure, and to fix the problems you report.

12.3 Who we share it with

We do not sell or share personal information, or use it for advertising. We disclose it only to the people you share results with in the app; to service providers that handle it for us under contract (hosting and storage, our database, the cloud computers that run the analysis, Google for sign-in, and email delivery); to authorities when the law requires it; and to a buyer of our business, on the terms in section 4.

12.4 Where it is kept

In the United States and in other countries where our service providers run servers, under data processing agreements.

12.5 How long we keep it

  • Your account details: for as long as we run Deep Third.
  • Recordings and results in the app: we have not set a fixed period. Until we do, we keep them, and we will tell you at least 30 days before a set period starts.
  • Copies in our training data: without a time limit, under the licence in the terms of use. Each copy is labelled with a random identifier, and the link to your account is kept separately.
  • The record of what you agreed to: for as long as we rely on it.
  • Request logs: up to 7 days.

12.6 People who appear in recordings

We do not use facial recognition. The app does not find faces in recordings, does not measure faces or make face templates, and does not identify anyone by their face or by any other means. We never train any model to do these things.

To show the clips of each bowler and batter, the app groups the players in a session by the overall look of each player's whole figure, such as their kit and build. It does this within one session only and does not compare people across sessions. Each group gets a label such as "Batsman 3"; a name appears only if the user types one. The terms of use ask people to upload only sessions played outside Illinois, Texas, Washington, Colorado and Connecticut. If an upload's connection comes from one of those states, or from outside the United States, the app does not group the players in that recording.

12.7 Children

Accounts are for people aged 18 or over. A recording may show players under 18 only if a parent or guardian of each of them has agreed; the person uploading confirms this on the upload page. If we learn that an upload breaks this rule, we may remove it.

12.8 Your choices in the app

Recordings you upload, and what we derive from them, are covered by the perpetual and irrevocable licence in the terms of use (section 4.3). Email admin@deepthird.com to get a copy of your account details or to correct them; we answer within 30 days. You can stop the emails about Deep Third at any time; while your account is open, we still send the emails about your own analysis.

12.9 Cookies and storage in the app

The app uses one cookie to keep you signed in, and your browser stores the progress of an upload so that it can resume after a break. The app uses no analytics or advertising cookies.

13. Changes to this policy

The version and effective date are at the top. If we make a material change, we will email the people on the waitlist and the people using the app before it applies. We will not use the details we already hold for a new purpose without asking you first.
